Terms of Use

By accessing or using PlotBuilt, you agree to be bound by these Terms of Use. If you do not agree, you may not use the service. We may update these terms from time to time, as described below.

PlotBuilt is intended for use by individuals who are at least 18 years old. By creating an account, you represent that you meet this requirement and that you have the legal capacity to enter into these terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized access to your account.

You agree to provide accurate information when creating an account and when entering property details, and to use PlotBuilt only for lawful purposes consistent with these terms.

PlotBuilt lets you record details you gather about a property — such as parcel figures, utilities, listing status and contacts. This information is user-generated. PlotBuilt does not independently verify it, and you are responsible for its accuracy.

PlotBuilt allows you to upload photographs and documents to build a vision board. You are solely responsible for the content you upload, including its legality and appropriateness.

By uploading any material to PlotBuilt, you represent and warrant that you own that material or have permission from its owner to upload, store and share it through the service. This representation is confirmed each time you accept the upload checkbox described in our Acceptable Use and Uploaded Content Policy.

You grant PlotBuilt a limited, non-exclusive, non-transferable license to store, process and display the content you upload solely for the purpose of providing the service to you and to anyone you choose to share a board with. This license does not give us any right to use your content for any other purpose.

You retain all ownership rights in the content you upload. We do not claim ownership of your photographs, documents or property notes.

You may not upload copyrighted listing photographs or marketing materials belonging to another party without that party’s permission. You may not scrape, automatically import or otherwise copy listing content from Redfin, Zillow, Realtor.com, an MLS system or any other third-party source without proper authorization from that source.

You may not use PlotBuilt to upload, store or share content that is:

• Illegal, deceptive or fraudulent
• Discriminatory or harassing toward any person or group
• Infringing on another party's intellectual property rights
• Malicious, including malware or code intended to harm systems
• Privacy-invasive, including content that discloses another person's private information without consent

PlotBuilt is an organizing and presentation tool. It does not provide surveying, engineering, architectural, appraisal, inspection, title, environmental, insurance, lending, legal or real-estate brokerage advice. Nothing on PlotBuilt should be treated as a substitute for advice from a licensed professional in the relevant field.

PlotBuilt does not guarantee the accuracy of any property information, including availability, buildability, zoning status, permitted use or the feasibility of any project shown on a board. You are responsible for independently verifying these facts with the appropriate local authorities and licensed professionals.

PlotBuilt uses Google Maps Platform to help confirm property locations and display map, satellite and Street View context, and may use other third-party services to operate the product. Your use of these embedded services is also subject to the applicable third-party terms.

Sample boards, demonstration content and architectural collections shown in PlotBuilt are provided for illustration and inspiration only. They may be fictional, generic or not specific to any particular site, and should not be relied upon as accurate representations of a real property or a buildable design.

PlotBuilt does not currently charge for the service. If we introduce paid plans, updated payment terms will be presented and will require your acceptance before you are charged.

Once paid plans are available, cancellation and refund terms will be described in our Subscription, Cancellation and Refund Policy, which is incorporated into these terms by reference.

We may modify, suspend or discontinue any part of PlotBuilt at any time. We will try to provide reasonable notice of material changes that affect your access to your data, but we cannot guarantee uninterrupted availability.

We may suspend or terminate your account if you violate these terms, misuse the service, or if required by law. You may stop using PlotBuilt and delete your account at any time, as described in our account deletion instructions.

PlotBuilt, including its software, design, branding and underlying technology, is owned by Shaka Software LLC. Except for the limited rights granted to you to use the service, no rights are transferred to you under these terms.

PlotBuilt is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

To the fullest extent permitted by law, PlotBuilt and Shaka Software LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of the service. Our aggregate liability for any claim relating to the service will not exceed the amount you paid us, if any, in the twelve months before the claim arose.

You agree to indemnify and hold harmless Shaka Software LLC from any claims, damages or expenses arising out of your content, your use of the service, or your violation of these terms.

These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Shaka Software LLC is organized in Wyoming. This governing-law provision is stated pending final legal review, and will be updated if counsel advises a change before PlotBuilt charges for the service.

This draft does not include an arbitration clause or a class-action waiver. Any such terms would materially change your legal rights and would require review and approval by the owner and legal counsel before being added.

We may update these Terms of Use from time to time. Material changes will be reflected by an updated effective date at the top of this page.
